Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry.

  1. Entry is free and open to all global residents aged 18 years or older. Employees and immediate families of the Promoter and any suppliers, providers and agencies associated with this promotion are ineligible to enter.
  2. The promotion commences 1st November 2010 at 9.00 am AEDST ("Australian Eastern Daylight Savings Time") and entries close 1st December 2010 at 8.59 am AEDST. To enter the promotion, eligible entrants must complete all required fields on the entry form available at www.RealLifeExperiences.com including selecting the Intrepid Real Life Experience they would like to win (from the Real Life Experience and corresponding trips specified in the Annexure of these Conditions of Entry) and an answer to the question 'Tell us why you want to win this Real Life Experience' in 25 words or less, and submit the fully completed entry form by 8.59 am AEDST on 1st December 2010. No entries will be received by the Promoter after 8.59 am AEDST on 1st December 2010. For the purposes of this promotion, a day is a 24 hour period between 9.00 am AEDST to 8.59 am AEDST the following day.
  3. Entrants can only enter their own name on the entry form. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter also reserves the right, at any time, to request proof of residency at the address stated on the entry form and identification for verification (to the Promoter's satisfaction, in its discretion) in order to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) before issuing a prize.
  4. Incomplete or incomprehensible entries will be deemed invalid. Entries containing and/or depicting illegal, sexually explicit or morally offensive content will be ineligible to enter. The Promoter's decision on all matters is final and no correspondence will be entered into. No responsibility will be taken for lost, late or misdirected entries.
  5. Entrants may only enter once a day for the entire duration of the promotion.
  6. All eligible entries received each day during the promotional period will be judged by a panel of judges nominated by the Promoter. Each entry will be individually judged based on the creative merit of the answer provided to the question: 'Tell us why you want to win this Real Life Experience'. There will be a total of thirty (30) winners selected for this promotion. Each winner will be notified by email following the judging (approx. 24 hours) and their name and entry will be published on www.RealLifeExperiences.com and may also be published on the Promoter's social media sites. Details of each winner (initial of first name, last name and city/state of residence) may also be announced in the Intrepid Express e-newsletter. In the event that a selected winner is deemed invalid, the prize will not be won by the invalid winner and an alternate winner will be selected from all remaining (non-winning) eligible entries received.
  7. The best valid entry selected each day of the promotional period, as determined by the judges, will each win the Intrepid trip nominated on their entry form. Each prize is for one (1) adult only. Winners should see www.RealLifeExperiences.com for more information on the prize inclusions and value of the prize. 
  8. Prizes do not include any transport to and from the Intrepid trip departure point (including international or domestic airfares) and it is the responsibility of the winners to make their own way to the Intrepid trip departure point, at their own expense.
  9. Spending money, meals, travel taxes, travel insurance, passports, visas, vaccinations, transfers and all other ancillary costs (as well as obtaining any of these) not specified in the prize inclusions are the responsibility of each winner. Prizes must be booked and taken by 1st December 2011, otherwise, it will be deemed to be forfeited by the winner and the prize will not be redeemable for cash. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Prizes are subject to the standard terms and conditions of individual prize and service providers. Each winner is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. All components of a prize must be taken together or otherwise are deemed to be forfeited by the winner and cash will not be awarded in lieu. Travel is subject to booking availability and black out periods may apply.. Travel must be arranged by the winners contacting the Promoter and quoting promotion #5566. The Promoter will not contact winners to arrange travel as this is the responsibility of each winner. Some trips must meet minimum number requirements prior to confirmation. If a trip that the winner has booked does not reach its minimum number requirement, the winner will be informed and will have the opportunity to transfer to another Intrepid Travel trip.
  10. The Promoter accepts no responsibility for any variation in the prize value. Prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  11. In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same or greater value as the original Intrepid trip or, to cancel, terminate, modify or suspend the promotion.
  12. Winners acknowledge that some elements of their prize may be considered a dangerous activity ("Activity") that may result in injury or death, and participate at their own risk. Winners must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in the Activity if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous.
  13. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability, which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures. Tax implications may arise from the receipt or taking of a prize. Independent financial advice should be sought.
  14. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion. The Promoter also reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  15. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrants or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.
  16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (b) any tax liability incurred by a winner or entrant; or (c) taking of a prize.
  17. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  19. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  20. The Promoter collects contact information about entrants in order to: (a) contact the entrant about the promotion; (b) award prizes; (c) use the information to assist the Promoter in improving goods and services; and (d) to contact entrants in the future with special offers via any medium including mail and commercial electronic messages. If entrants do not provide the information, they cannot participate.   21. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
